Let's Talk About Trusts, Bequests and the Simple Will

Looking Ahead...

It's quite natural to wonder about the future. Many contributors have asked in what ways they might continue to support the programs and works of the ARRL Foundation throughout a lifetime or beyond. Perhaps you've considered the tax benefits of a regular trust fund that can be established at any time during your lifetime. Regular contributions to your Foundation-administered trust can provide tax-deductions while helping fund any Foundation program(s) you wish to support. Please contact the ARRL Foundation to discuss establishing a trust. You and the Foundation can benefit by this on-going, cost effective plan.

Thank you for your interest in making a permanent contribution to Amateur Radio through the ARRL Foundation.

Another way to assure the future of Amateur Radio through Foundation programs is by making a bequest. We highly recommend an attorney provide assistance when you are considering a bequest, or any modification to your will, as state and local laws must be considered when executing a bequest made with even a Simple Will. Your attorney can advise you and tailor your Simple Will to your precise wishes. We have provided a "sample" Simple Will form, as well as clauses (see below) that you and your attorney can use when planning an ARRL Foundation bequest.

The Foundation is a tax-exempt organization under Section 501 (c) (3) of the Internal Revenue Code. As such, the amount of the bequest may be deducted from your gross estate for Federal Estate Tax purposes, according to current IRS Code. Check with your attorney for specific information about tax-exemptions under this Code.

The following "items" are guidelines only, to help define how you wish your bequest to be used. Please take a moment to read and mark the "item" or "items" that agree with your bequest plans. Mark out or line-through those "items" that do not apply to your bequest plans. Keep this information on file with your will and other pertinent testimentary documents.


ITEM I. [Undesignated] I hereby give, devise and bequeath unto the ARRL Foundation, Inc., a charitable, not-for-profit, tax-exempt organization with headquarters in Newington, Connecticut 06111, the sum of _______________________ Dollars [$ .00]. This bequest may be used and applied toward any program or project of the Foundation which the Directors thereof shall deem most important at the time of my death; provided, however, that no portion of this bequest shall be applied toward any program or project of the Foundation which shall jeopardize its status as a tax-exempt organization under Section 501 (c) (3) of the Internal Revenue Code of 1954, as amended, or any corresponding provision in a subsequent Federal Tax law.

OR

ITEM II. [Designated] I hereby give, devise and bequeath unto the ARRL Foundation, Inc., a charitable, not-for-profit, tax-exempt organization with headquarters located at 225 Main Street, Newington, Connecticut 06111, the sum of ______________________ Dollars [$ .00] to be used only for the purpose of funding the following: [Write-in which program or fund you wish to support] ____________________________________, which is fully in keeping with the status of the Foundation as a tax-exempt organization under Section 501 (c) (3) of the Internal Revenue Code of 1954, as amended.

OR

[There may arise a situation where you may wish to make certain bequests to relatives or friends and then leave the residue to the Foundation.]

ITEM III. [Residue] All the rest, residue and remainder of my property and estate, of every character and description and whatsoever situate, of which I may die seized and possessed, or to which I may have any right, title, interest or entitlement at the time of my death, after payment of all debt, costs of administration, inheritance taxes and other death taxes, I give, devise and bequeath unto the ARRL Foundation, Inc., a charitable, not-for-profit, tax exempt organization with headquarters located at 225 Main Street, Newington, Connecticut 06111. This bequest may be used and applied for the funding of such programs of the Foundation which the Directors thereof shall deem most important at the time of my death; provided, however, that no portion of this bequest shall be applied toward any program or project of the Foundation which shall jeopardize its status as a tax-exempt organization under Section 501 (c) (3) of the Internal Revenue Code of 1954, as amended, or any corresponding provision in a subsequent Federal Tax law.

It is through the generosity and concern of many individuals like yourself that the ARRL Foundation can maintain programs and projects that provide for the preservation and enhancement of Amateur Radio. Thank you, once again, for your interest.

LAST WILL AND TESTAMENT OF

I, __________________________________, a resident of, and domiciled in, the City of ______________________, County of ___________________, and State of __________________________, make, publish, and declare this my will, revoking all former wills made by me.

In consideration of its educational and scientific contributions to Amateur Radio and community at large, I hereby give and bequeath to the ARRL Foundation, a 501 (c) (3) not-for-profit Corporation, at 225 Main Street, Newington, Connecticut 06111, the sum of $_____________________.

I give, devise and bequeath to my _____________________, if (s)he survives me, the balance of all my property, real and personal. If my ________________ does not survive me, I give, devise and bequeath to my issue all my property, real and personal.

I empower my executor to sell, at public or private sale, any part of my estate, real and personal, at times and upon terms and conditions that (s)he deems proper.

I nominate and appoint as Executor of this will my _______________. If (s)he fails to qualify or ceases to act I nominate and appoint my __________________________, as Executor of this will. I direct that no bond be required of my Executor.
